This agreement is between MADANI HAJJ TOURS LONDON LTD and you the applicant/beneficiary. On completion of your booking it is agreed that you have accepted and will adhere to all the terms and conditions herein:
1. All applications for travel with MADANI HAJJ TOURS LONDON LTD must be fully completed using our manual/over the phone or online booking forms.
2. Contract Forms: Applicant must complete the contract form accompanied by a non-refundable initial deposit of £2000.00 (Two thousand pounds only) per booking for Hajj. We will send you a receipt for your initial deposit in due course upon payment. In the case of online bookings, if no firm commitment is made and no deposit has been received by us we would not consider you as an interested applicant for Hajj with our company.
Please note that no confirmation of your successful application or commitment will be entered between the applicant and MADANI HAJJ TOURS LONDON LTD unless the applicant would receive an invoice from us.
4. Payment of Balance:
The balance of your chosen package must be paid in full at least four (4) weeks prior to departure date. All payments must be in Pounds Sterling. If the balance is not settled by the specified time, MADANI HAJJ TOURS LONDON LTD reserves the right to cancel the booking without further notice.
It is the responsibility of the applicant to provide all necessary documentation for processing the visa at least six (6) weeks prior to departure. Any applicant who fails to pay his/her balance before the four-week deadline will have such documentation returned to them and will lose the deposit, as stated in paragraph (2) above or any other deposits they have given. Applicants who have paid the balance in full and do not supply the correct documentation before the deadline will have their booking cancelled, losing their all deposit and/or part of the package costs.
All applicants who travel with MADANI HAJJ TOURS LONDON LTD are expected to behave in a manner which is conducive to the journey that they are making. Please be advised that under no circumstances should travellers be involved in brawls, fights or arguments, or display behaviour which would be seen as detrimental to the image which MADANI HAJJ TOURS LONDON LTD desires to be shown by a person undertaking a journey.
7. Change of Booking:
Any applicant wishing to change their departure dates, which MADANI HAJJ TOURS LONDON LTD have available at the time of booking or shortly thereafter must do so at least eight (8) weeks prior to departure. An alteration fee will be charged for each person who makes a change in their booking options subject to its availability. Persons wishing to add subsequent members to their family group may do so, subject to places being available, but they will still be subjected to the same booking and deposit requirements as stated above in paragraph 2.
Applicants are required to send a written cancellation notice. Initial deposits are non-refundable once MADANI HAJJ TOURS LONDON LTD has confirmed your booking. Thereafter, any cancellation for Hajj must be made not later than eight weeks before the trip. Fees are non-refundable, and you, the applicant will be liable for the full cost of the package.
“Many of the flights and flight-inclusive holidays on this website are financially protected by the ATOL scheme. But ATOL protection does not apply to all holiday and travel services listed [in this brochure/on this website]. Please ask us to confirm what protection may apply to your booking. If you do not receive an ATOL Certificate then the booking will not be ATOL protected. If you do receive an ATOL Certificate but all the parts of your trip are not listed on it, those parts will not be ATOL protected. Please see our booking conditions for information or for more information about financial protection and the ATOL Certificate go to: www.atol.org.uk/ATOLCertificate.”
10. Your Financial Protection:
“When you buy an ATOL protected flight or flight inclusive holiday from us you will receive an ATOL Certificate. This lists what is financially protected, where you can get information on what this means for you and who to contact if things go wrong. We, or the suppliers identified on your ATOL Certificate will provide you with the services listed on the ATOL Certificate (or a suitable alternative). In some cases, where neither we nor the supplier are able to do so for reasons of insolvency, an alternative ATOL holder may provide you with the services you have bought or a suitable alternative (at no extra cost to you).
You have accepted that in those circumstances, the alternative ATOL holder will perform those obligations and you also agree to pay any money outstanding to be paid by you under your contract to that alternative ATOL holder. However, you also agree that in some cases it will not be possible to appoint an alternative ATOL holder, in which case you will be entitled to make a claim under the ATOL scheme (or your credit card issuer where applicable). If we, or the suppliers identified on your ATOL certificate, are unable to provide the services listed (or a suitable alternative, through an alternative ATOL holder or otherwise) for reasons of insolvency, the Trustees of the Air Travel Trust may make a payment to (or confer a benefit on) you under the ATOL scheme.
You have agreed that in return for such a payment or benefit you assign absolutely to those Trustees any claims which you have or may have arising out of or relating to the non-provision of the services, including any claim against us, the travel agent (or your credit card issuer where applicable). You also agree that any such claims may be re-assigned to another body, if that other body has paid sums you have claimed under the ATOL scheme.”
11. Difficulties you may have:
In particularly some unlikely events that an applicant finds that there is an element in their package which they dislike and the happening of such event falls outside the reasonable control of MADANI HAJJ TOURS LONDON LTD, we will use reasonable endeavours practicable at the time to correct such faults or report the problem to the proper authority for their immediate intervention. This does not include services which do not form part of the programmed trip and or itinerary.
12. Booking and completed application:
We shall take reasonable steps to inform all applicants of the times and dates of travel as soon as they are confirmed to us by the airline concerned. We will ensure that confirmation is sent to each applicant. However, in the case of family groups, one booking confirmation form will be sent to listing all party members to the relevant applicant. It is the applicant’s sole responsibility to complete the booking form correctly. Full names, titles and any initials must be properly spelt according to each individual passport, as late changes or alterations to the airline tickets will incur a fee per ticket. Each applicant must have a valid vaccination certificate with them before travelling and must be available for checking at the airport under the Hajj Ministry Compliance Rules in accordance with Saudi Arabian policy for Hajj and Umrah pilgrimage visas. If any of the aforementioned issues in this paragraph are not notified to us within a specific time, MADANI HAJJ TOURS LONDON LTD will not be liable for any difficulties and delays which may arise or refusal of a visa by the Saudi Consulate.
13. Delays / Date Changes:
We, the agent reserve the right to change the departure dates without notice but we will reasonably endeavour to inform all applicants of changes made prior to the date of departure. However we will not be liable for delays and / or cancellation of flights to and from the United Kingdom resulting from any Act of God, adverse weather conditions rescheduling times by the Airlines, Airport Authorities and / or actions by the Air Traffic Controllers, mechanical breakdown, strike or industrial action or otherwise, which are and any further event including beyond our control. In those circumstances, your change of departure or cancellation of your flight will be affected by some un-foreseeable circumstance, where the Company has no control over.
(a)We the agent would not be responsible or liable for you missing your scheduled flight for departure whatever the reason i.e. road traffic or any other form of excuses. We have advised to you that you must arrive at the airport at least 4 hours before the departure of your flight.
(b) Madani Hajj Tours London Ltd will not be responsible at all for any losses, claims or problems incurred by you if you choose to buy your own ticket and/or select your own arrangements for your trip to & from Saudi Arabia in order to perform your Hajj, be it for any reason, including but not exhaustively: reasons of inconvenience, missing your flights for any reason and/or any kind of loss suffered, however, and whatever the form or cause.
(c) We have advised you on the first instance of you filling in the application for performing your Hajj with Madani Hajj Tours London about the nature of difficulties you may or would experience during the course of your Hajj i.e. Hajj is a very challenging religious duty and you must be physically fit for this journey. Accordingly, you were also advised that you must seek medical advice from your doctor towards your inspecting your fitness for this challenging journey and you are also required to take any necessary medicines and/or other medical equipment and/or medical methods and/or be medically informed and/or advised before travelling for Hajj. You are also strongly advised that if you have any known medical problem which is ongoing, you should take any adequate medicines and/or treatments or methods or information that would cover your package for up to three (3) weeks or longer. You are also requested to give us a copy of your prescriptions for our records. If necessary, we may be able to assist you in some emergency situations. Please note that Madani Hajj Tours London would not be responsible for your own negligence or ignorance but we would take reasonable endeavours to assist you if you get ill during your Hajj period within our means only.
(d) You must keep your belongings with you or secure your valuable things within your own means and Madani Hajj Tours London will not be responsible for any loss incurred by you regarding any kind of belongings, including money or other valuables.
(e) We have advised you that it may be the case that your luggage would be missing upon arrival at Saudi Arabia or at UK airports upon your return from the Hajj. We have advised you that it is possible, though not common. If in the event of such circumstances arising, you agree that you shall have a claim against the Airline for any missing luggage or items or objects of any nature, however, Madani Hajj Tours London shall not be responsible. Further to this, we would reasonably and practicably assist you to recover any missing luggage/items/valuables where possible.
(f) We would take you for Ziarah i.e. sights seeing for some historical places within our packages but we do not encourage or recommend climbing some places such as Zabale Rahma, Zabale Noor or Zabale Soor because there is very high risk involved and highly hazardous. If anybody decides to climb up, it would be treated as your own decision.
(g) Madani Hajj Tours London Ltd will not be liable for any injury, illness, death, loss (for example loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever and howsoever caused except as it may be limited and imposed by law. In any event, Madani Hajj Tours London Ltd shall not be liable for any such instances above if Madani Hajj Tours London Ltd and its staff have no fault of their own and/or it was caused by the individual/s concerned or any other individual/s or third party.
(h) Paragraph g) is to be read in line with Madani Hajj Tours London Ltd firm commitment to fulfilling all our valid contractual agreements.
We have compiled the information in our brochure to be accurate at the time of going to press. However, as the brochure and its corresponding information are prepared in advance, there may be instances where an advertised facility may be altered or no longer available, which will be for reasons beyond our control. It may also be necessary for us to change some detail concerning the trip programme and the itinerary due to circumstances beyond our control. It is essential that your expectations of the trip do not surpass what we have outlined in our brochure or exceed the limitations of the MADANI HAJJ TOURS LONDON LTD programme. We accept no liability for any disappointment which may arise as a result of your unrealistic views and expectations. Furthermore, the operation of certain amenities and facilities may be subject to local or religious laws. Maintenance and local energy conservation measures may mean that hotel or apartments may limit facilities such as air conditioning or water supplies and in some circumstances, adverse weather conditions have been known to cause electrical failure. In such circumstances, we accept no liability for these restrictions; neither do we accept any liability for loss or damage arising from the above. The operation and supervision of overseas property, transport and other services are subject to local laws, regulations, standards and codes of practice of individual countries. The legal and safety requirements of many foreign countries are of a lower standard than that of the U.K. You should note that the standards imposed will be that of the country you are visiting and not of the U.K.
16. Accommodation & Transport for Hajj & Umrah:
All our hotel rooms are shared accommodation and individuals wishing for private rooms need to book in advance the required room and ensure adequate payment is made. Star ratings are done according to the Saudi Ministry of Trade Standards and all information pertaining to room conditions and facilities has been supplied by our agents. We do endeavour to ensure that at the time of going to press, the accommodation is of the highest quality which we can provide. We reserve the right to make changes to the name of the hotel accommodation without notice. Accommodation in Mina and Arafat is in the tents provided by the Hajj Ministry; please note that there are no tents in Muzdalifah and individuals will have to make their own arrangement. All transportation during the days of Hajj are also provided by the Hajj Ministry, please be prepared for serious delays and/as these are beyond the control of MADANI HAJJ TOURS LONDON LTD. We have also reminded you that most difficult and very challenging part of Hajj is i.e. journey from Arafah to Muzdalifah and from Muzdalifah to Mina because everything is not working in order and you would find it very difficult to board on your Madani Hajj Tours London allocated bus by the Hajj Ministry but we would do our best to make everything for your convenience and comfort within our means.
17. Price changes:
It may be necessary to increase the costs of the advertised package at any time before you receive confirmation without any prior notice. After confirmation, all price increases will take place not less than 30 days before your departure date. These prices are due to elements beyond our control, not limited to but including any one or a combination of the following: transportation costs, dues, taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airports, fuel prices rising, exchange rates dropping severely down or air tickets being increased significantly after agreement and the Moallim has failed to provide the necessary transport that were in the packages which were agreed at the time of your booking with Madani Hajj Tours London.
Unless we have no other alternative, we would be honest and sincere to claim extra costs from you to cover the increases. In compliance with Travel Regulations, price increases of up to 2% will be covered by us, but if the increased price is over 2% we will seek the extra cost from you. If any change in our costs would cause a reduction in your holiday price, we will not make refunds of increased amounts lesser than 2% of your holiday price but we will refund in full amounts exceeding 2%, after deducting any relevant administration charge.
18. Major Alterations
We strive to deliver our package exactly as promised in so far as we can. We shall not be liable for any major alteration of our Hajj Package caused as a result of any factor/s beyond our control. Such factors may include though not exhaustively Hajj Ministry or governmental action, Hajj congestion or legal actions, airport congestions, delays caused beyond our control, Acts of God and/or Acts of Terror.
19. Minor Alterations
We reserve the right to make any minor alteration/s to the package if necessary and/or caused as a result of factors beyond our control. Though we endeavour that no minor alterations are made at all, if it is made we shall in so far as things are in our control and reasonable, accurately ensure that there are no negative effects in relation to the overall accuracy quality, description or nature of your tour with us.
It is a condition of booking with every tour operator that you have adequate insurance cover. Such insurance will ensure that you are properly covered against unexpected cancellation charges, medical costs that might be incurred while you’re away, loss of money, or belongings, or personal liability claims. Please note that the cover offered by most credit card companies is not normally adequate for a package holiday or holiday flight bookings. MADANI HAJJ TOURS LONDON LTD do not offer insurance cover with any of its products, MADANI HAJJ TOURS LONDON LTD would strongly urge you to make your own independent insurance provision/s.
21. Our Commitments to you:
MADANI HAJJ TOURS LONDON LTD has taken all reasonable steps to ensure that your journey is conducted with comfort, is pleasant and with as minimum difficulties as possible. In the event that any difficulty should arise which has not been mentioned above, we will reasonably endeavour to correct such difficulty without any undue delay and with minimal inconvenience.
